The terms for using Tomatino: what it is, what you can expect from it, and what we ask of you in return.

1.About these terms
These terms apply when you use Tomatino, the focus timer on this website, in a browser or installed as an app. In these terms, “Tomatino”, “we” and “us” mean the Tomatino service and the people who run it.
By using Tomatino, you agree to these terms. If you don’t agree, please don’t use it. Our Privacy Policy explains what information Tomatino handles and how.
2.What Tomatino is
Tomatino is a focus timer. Around the timer, it offers tasks and projects, focus history and stats, Focus environment sounds, templates, away alerts, guides, and an optional account to sync your data across devices. Tomatino is currently free to use.
3.Using Tomatino without an account
You don’t need an account to use Tomatino. Without one, your data is stored in your browser on that device. Clearing your browser’s data, or losing the device, can delete it, and we can’t recover it for you. Tomatino lets you back up your data to a file at any time.
4.Accounts
To create an account, you need an email address that you control and a password. Please:
- give an email address that’s yours, so you can reset your password and receive account emails
- keep your password secure, and don’t use it for other services
- not share your account, or use someone else’s
- tell us if you think someone else has used your account
You’re responsible for what happens in your account, unless it happens because of something we did wrong.
5.Acceptable use
Please use Tomatino for its purpose: focusing and planning your own work. Don’t:
- break the law, or use Tomatino to store or send anything unlawful
- try to get into accounts or data that aren’t yours
- interfere with Tomatino or its servers, including by sending automated requests at a volume that could disrupt it
- probe, scan or test Tomatino’s security without our permission
- use Tomatino’s name or logo in a way that suggests we endorse you
6.Your data
What you put into Tomatino, such as your tasks, projects and focus history, stays yours. If you have an account, you allow us to store, copy and send it between your devices as needed to provide Tomatino to you. The Privacy Policy explains how that works.
Tomatino lets you back up your data, export your focus history and restore a backup at any time. We can’t promise that data will never be lost, so keep a backup of anything that matters to you.
7.Availability and changes
We want Tomatino to be reliable, but we can’t promise it will always be available or free of errors. We may change, add or remove features, and we may stop offering accounts and sync, or Tomatino itself. If we plan to stop offering sync or Tomatino, we’ll give account holders reasonable notice where we can, so you can back up your data first.
8.Deleting your account and ending these terms
You can stop using Tomatino at any time. You can delete your account in Tomatino, under Account. Deleting it permanently deletes the account and its synced data, as described in the Privacy Policy, and can’t be undone.
We may suspend or close an account that seriously or repeatedly breaks these terms, or if we have to in order to protect Tomatino, other people or comply with the law. Where it’s reasonable, we’ll tell you first.
9.Tomatino’s content
Tomatino’s software, design, name, logo, sounds and guides belong to us or to the people we license them from. These terms let you use Tomatino as described here; they don’t give you any other rights in it.
10.Other services
Some features rely on services we don’t control, such as our hosting provider, your browser’s push service for away alerts, and our email provider for account emails. The Privacy Policy lists them. Guides link to other websites as sources; we’re not responsible for those websites.
11.A tool, not a guarantee
Tomatino helps you time and plan your focus. Its guides and suggestions are general information, not medical, health or professional advice.
Timers and alerts depend on your device and browser. Away alerts are best effort: your browser or operating system decides when, and whether, to show them. Don’t rely on Tomatino where a missed or late alert could cause harm.
As far as the law allows, Tomatino is provided “as is”, without promises beyond those in these terms.
12.Liability
As far as the law allows, we’re not responsible for indirect or unforeseeable loss, or for lost data, time or income, that comes from using Tomatino or not being able to use it.
Nothing in these terms limits or excludes any liability that can’t be limited or excluded by law, or takes away rights you have by law, including your statutory rights as a consumer.
13.Changes to these terms
We may update these terms. We’ll publish the new version here and update the date at the top, and for significant changes we’ll tell account holders before they take effect. If you keep using Tomatino after a change takes effect, the updated terms apply.
